Please read them. They apply to 11the software named above, which includes the media on which you received it, if 12any. The terms also apply to any Microsoft 13updates, 14supplements, 15Internet-based services, and 16support services 17for this software, unless other terms accompany those items. If so, those terms 18apply. 19By using the software, you accept these terms. If you do not accept them, do 20not use the software. 21As described below, using some features also operates as your consent to the 22transmission of certain standard computer information for Internet-based 23services. 24________________________________________________________________________________ 25________________ 26If you comply with these license terms, you have the rights below. 27 281. INSTALLATION AND USE RIGHTS. 29a. You may install and use any number of copies of the software on your devices 30to design, develop and test your programs that run on a Microsoft operating 31system. Further, you may install, use and/or deploy via a network management 32system or as part of a desktop image, any number of copies of the software on 33computer devices within your internal corporate network to design, develop and 34test your programs that run on a Microsoft operating system. Each copy must be 35complete, including all copyright and trademark notices. You must require end 36users to agree to terms that protect the software as much as these license 37terms. 38b. Utilities. The software contains certain components that are identified in 39the Utilities List located at http://go.microsoft.com/fwlink/?LinkId=524839. 40Depending on the specific edition of the software, the number of Utility files 41you receive with the software may not be equal to the number of Utilities 42listed in the Utilities List. Except as otherwise provided on the Utilities 43List for specific files, you may copy and install the Utilities you receive 44with the software on to other third party machines. These Utilities may only be 45used to debug and deploy your programs and databases you have developed with 46the software. You must delete all the Utilities installed onto a third party 47machine within the earlier of (i) when you have finished debugging or deploying 48your programs; or (ii) thirty (30) days after installation of the Utilities 49onto that machine. We may add additional files to this list from time to time. 50c. Build Server List. The software contains certain components that are 51identified in the Build Server List located at 52http://go.microsoft.com/fwlink/?LinkId=524838. You may install copies of the 53files listed in it, onto your build machines, solely for the purpose of 54compiling, building, verifying and archiving your programs. These components 55may only be used in order to create and configure build systems internal to 56your organization to support your internal build environment. 57These components do not provide external distribution rights to any of the 58software or enable you to provide a build environment as a service to third 59parties. We may add additional files to this list from time to time. 60d. Included Microsoft Programs. The software contains other Microsoft programs. 61The license terms with those programs apply to your use of them. 62e. Third Party Notices. The software may include third party code that 63Microsoft, not the third party, licenses to you under this agreement. Notices, 64if any, for the third party code are included for your information only. 65Notices, if any, for this third party code are included with the software and 66may be located at http://go.microsoft.com/fwlink/?LinkId=524840. 67 682. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS. 69a. Distributable Code. The software contains code that you are permitted to 70distribute in programs you develop if you comply with the terms below. 71i. Right to Use and Distribute. The code and test files listed below are 72“Distributable Code”. 73REDIST.TXT Files. You may copy and distribute the object code form of code 74listed in REDIST.TXT files plus the files listed on the REDIST.TXT list located 75at http://go.microsoft.com/fwlink/?LinkId=524842. Depending on the specific 76edition of the software, the number of REDIST files you receive with the 77software may not be equal to the number of REDIST files listed in the 78REDIST.TXT List. We may add additional files to the list from time to time. 79Third Party Distribution. You may permit distributors of your programs to copy 80and distribute the Distributable Code as part of those programs. 81ii. Distribution Requirements. For any Distributable Code you distribute, you 82must 83Add significant primary functionality to it in your programs; 84For any Distributable Code having a filename extension of .lib, distribute only 85the results of running such Distributable Code through a linker with your 86program; 87Distribute Distributable Code included in a setup program only as part of that 88setup program without modification; 89Require distributors and external end users to agree to terms that protect it 90at least as much as this agreement; 91For Distributable Code from the Windows Performance Toolkit portions of the 92software, distribute the unmodified software package as a whole with your 93programs, with the exception of the KernelTraceControl.dll and the 94WindowsPerformanceRecorderControl.dll which can be distributed with your 95programs; 96Display your valid copyright notice on your programs; and 97Indemnify, defend, and hold harmless Microsoft from any claims, including 98attorneys’ fees, related to the distribution or use of your programs. 99iii. Distribution Restrictions. You may not 100Alter any copyright, trademark or patent notice in the Distributable Code; 101Use Microsoft’s trademarks in your programs’ names or in a way that 102suggests your programs come from or are endorsed by Microsoft; 103Distribute partial copies of the Windows Performance Toolkit portion of the 104software package with the exception of the KernelTraceControl.dll and the 105WIndowsPerformanceRecorderControl.dll which can be distributed with your 106programs; 107Distribute Distributable Code to run on a platform other than the Microsoft 108operating system platform; 109Include Distributable Code in malicious, deceptive or unlawful programs; or 110Modified or distribute the source code of any Distributable Code so that any 111part of it becomes subject to an Excluded License. And Excluded License is on 112that requir3es, as a condition of use, modification or distribution, that 113The code be disclosed or distributed in source code form; or 114Others have the right to modify it. 115b. Additional Licensing Requirements and/or Distribution Rights for Features 116made Available with the Software. 117i. Windows App Requirements. If you intend to make your program available in 118the Windows Store, the program must comply with the Certification Requirements 119as defined and described in the App Developer Agreement, currently available 120at: https://msdn.microsoft.com/en-us/library/windows/apps/hh694058.aspx. 121ii. Bing Maps. The software may include features that retrieve content such as 122maps, images and other data through the Bing Maps (or successor branded) 123application programming interface (the “Bing Maps API”) to create reports 124displaying data on top of maps, aerial and hybrid imagery. If these features 125are included, you may use these features to create and view dynamic or static 126documents only in conjunction with and through methods and means of access 127integrated in the software. You may not otherwise copy, store, archive, or 128create a database of the entity information including business names, addresses 129and geocodes available through the Bing Maps API. You may not use the Bing Maps 130API to provide sensor based guidance/routing, nor use any Road Traffic Data or 131Bird’s Eye Imager (or associated metadata) even if available through the Bing 132Maps API for any purpose. Your use of the Bing Maps API and associated content 133is also subject to the additional terms and conditions at 134http://go.microsoft.com/fwlink/?LinkId=21969. 135iii. Additional Mapping APIs. The software may include application programming 136interfaces that provide maps and other related mapping features and services 137that are not provided by Bing (the “Additional Mapping APIs”). These 138Additional Mapping APIs are subject to additional terms and conditions and may 139require payment of fees to Microsoft and/or third party providers based on the 140use or volume of use of such Additional Mapping APIs. These terms and 141conditions will be provided when you obtain any necessary license keys to use 142such Additional Mapping APIs or when you review or receive documentation 143related to the use of such Additional Mapping APIs. 144iv. Push Notifications. The Microsoft Push Notification Service may not be used 145to send notifications that are mission critical or otherwise could affect 146matters of life or death, including without limitation critical notifications 147related to a medical device or condition. MICROSOFT EXPRESSLY DISCLAIMS ANY 148WARRANTIES THAT THE USE OF THE MICROSOFT PUSH NOTIFICATION SERVICE OR DELIVERY 149OF MICROSOFT PUSH NOTIFICATION SERVICE NOTIFICATIONS WILL BE UNINTERRUPTED, 150ERROR FREE, OR OTHERWISE GUARANTEED TO OCCUR ON A REAL-TIME BASIS. 151v. Speech namespace API. Using speech recognition functionality via the Speech 152namespace APIs in a program requires the support of a speech recognition 153service. The service may require network connectivity at the time of 154recognition (e.g., when using a predefined grammar). In addition, the service 155may also collect speech-related data in order to provide and improve the 156service. The speech-related data may include, for example, information related 157to grammar size and string phrases in a grammar. 158vi. Also, in order for a user to use speech recognition on the phone they 159must first accept certain terms of use. The terms of use notify the user that 160data related to their use of the speech recognition service will be collected 161and used to provide and improve the service. If a user does not accept the 162terms of use and speech recognition is attempted by the application, the 163operation will not work and an error will be returned to the application. 164vii. API Use. We may monitor and collect data related to a program’s use of 165APIs in order to provide, improve and personalize Microsoft products and 166services. End user information collected by Microsoft‘s monitoring and data 167collection related to your program’s use of APIs is subject to the Microsoft 168Consumer Privacy Statement. 169viii. Location Framework. The software may contain a location framework 170component that enables support of location services in programs. In addition 171to the other limitations in this agreement, you must comply with all applicable 172local laws and regulations when using the location framework component or the 173rest of the software. 174ix. Device ID Access. The software may contain a component that enables 175programs to access the device ID of the device that is running the program. In 176addition to the other limitations in this agreement, you must comply with all 177applicable local laws and regulations when using the device ID access component 178or the rest of the software. 179x. PlayReady Support. The software may include the Windows Emulator, which 180contains Microsoft’s PlayReady content access technology. Content owners use 181Microsoft PlayReady content access technology to protect their intellectual 182property, including copyrighted content. This software uses PlayReady 183technology to access PlayReady-protected content and/or WMDRM-protected 184content. Microsoft may decide to revoke the software’s ability to consume 185PlayReady-protected content for reasons including but not limited to (i) if a 186breach or potential breach of PlayReady technology occurs, (ii) proactive 187robustness enhancement, and (iii) if Content owners require the revocation 188because the software fails to properly enforce restrictions on content usage. 189Revocation should not affect unprotected content or content protected by other 190content access technologies. Content owners may require you to upgrade 191PlayReady to access their content. If you decline an upgrade, you will not be 192able to access content that requires the upgrade and may not be able to install 193other operating system updates or upgrades. 194xi. Package Managers. The software may include package managers, like NuGet, 195that give you the option to download other Microsoft and third party software 196packages to use with your application. Those packages are under their own 197licenses, and not this agreement. Microsoft does not distribute, license or 198provide any warranties for any of the third party packages. 199xii. Font Components. While the software is running, you may use its fonts to 200display and print content. You may only embed fonts in content as permitted by 201the embedding restrictions in the fonts; and temporarily download them to a 202printer or other output device to help print content. 203xiii. Notice about the H.264/AVD Visual Standard, and the VC-1 Video Standard. 204This software may include H.264/MPEG-4 AVC and/or VD-1 decoding technology. 205MPEG LA, L.L.C. requires this notice: 206c. THIS PRODUCT IS LICENSED UNDER THE AVC AND THE VC-1 PATENT PORTFOLIO 207LICENSES FOR THE PERSONAL AND NON-COMMERCIAL USE OF A CONSUMER TO (i) ENCODE 208VIDEO IN COMPLIANCE WITH THE ABOVE STANDARDS (“VIDEO STANDARDS”) AND/OR 209(ii) DECODE AVC, AND VC-1 VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A 210PERSONAL AND NON-COMMERCIAL ACTIVITY AND/OR WAS OBTAINED FROM A VIDEO PROVIDER 211LICENSED TO PROVIDE SUCH VIDEO. NONE OF THE LICENSES EXTEND TO ANY OTHER 212PRODUCT REGARDLESS OF WHETHER SUCH PRODUCT IS INCLUDED WITH THIS SOFTWARE IN A 213SINGLE ARTICLE. NO LICENSE IS GRANTED OR SHALL BE IMPLIED FOR ANY OTHER USE. 214ADDITIONAL INFORMATION MAY BE OBTAINED FROM MPEG LA, L.L.C. SEE WWW.MPEGLA.COM. 215d. For clarification purposes, this notice does not limit or inhibit the use of 216the software for normal business uses that are personal to that business which 217do not include (i) redistribution of the software to third parties, or (ii) 218creation of content with the VIDEO STANDARDS compliant technologies for 219distribution to third parties. 220e. INTERNET-BASED SERVICES. Microsoft provides Internet-based services with the 221software. It may change or cancel them at any time. 222f. Consent for Internet-Based Services. The software features described below 223and in the privacy statement at http://go.microsoft.com/fwlink/?LinkId=521839 224connect to Microsoft or service provider computer systems over the Internet. In 225some cases, you will not receive a separate notice when they connect. In some 226cases, you may switch off these features or not use them. By using these 227features, you consent to the transmission of this information. Microsoft does 228not use the information to identify or contact you. 229i. Computer Information. The following features use Internet protocols, which 230send to the appropriate systems computer information, such as your Internet 231protocol address, the type of operating system, browser, and name and version 232of the software you are using, and the language code of the device where you 233installed the software. Microsoft uses this information to make the 234Internet-based services available to you. 235Customer Experience Improvement Program (CEIP). This software uses CEIP. CEIP 236automatically sends Microsoft information about your hardware and how you use 237the software. We do not use this information to identify or contact you. CEIP 238will also periodically download a small file to your computer. This file helps 239us collect information about problems that you have while using the software. 240When available, new help information about the errors might also be 241automatically downloaded. To learn more about CEIP and how to turn it off, see 242http://go.microsoft.com/fwlink/?LinkId=525878. 243Digital Certificates. The software uses digital certificates. These digital 244certificates confirm the identity of Internet users sending X.509 standard 245encryption information. They also can be used to digitally sign files and 246macros to verify the integrity and origin of the file contents. The software 247retrieves certificates and updates certificate revocation lists using the 248Internet, when available. 249Error Reports. This software automatically sends error reports to Microsoft. 250These reports include information about problems that occur in the software. 251Sometimes reports contain information about other programs that interact with 252the software. Reports might unintentionally contain personal information. For 253example, a report that contains a snapshot of computer memory might include 254your name. Part of a document you were working on could be included as well. 255Microsoft does not use this information to identify or contact you. To learn 256more about error reports, see http://oca.microsoft.com/en/dcp20.asp. 257Windows Application Certification Kit. To ensure you have the latest 258certification tests, when launched this software periodically checks a Windows 259Application Certification Kit file on download.microsft.com to see if an update 260is available. If an update is found, you are prompted and provided a link to 261a web site where you can download the update. You may use the Windows 262Application Certification Kit solely to test your programs before you submit 263them for a potential Microsoft Windows Certification and for inclusion on the 264Microsoft Windows Store. The results you receive are for informational purposes 265only. Microsoft has no obligation to either (i) provide you with a Windows 266Certification for your programs and/or ii) include your program in the 267Microsoft Windows Store. 268Microsoft Digital Rights Management for Silverlight. 269If you use Silverlight to access content that has been protected with Microsoft 270Digital Rights Management (DRM), in order to let you play the content, the 271software may automatically 272request media usage rights from a rights server on the Internet and 273download and install available DRM Updates. 274For more information about this feature, including instructions for turning the 275Automatic Updates off, go to http://go.microsoft.com/fwlink/?LinkId=147032. 2761. Web Content Features. Features in the software can retrieve related content 277from Microsoft and provide it to you. To provide the content, these features 278send to Microsoft the type of operating system, name and version of the 279software you are using, type of browser and language code of the device where 280you installed the software. Examples of these features are clip art, templates, 281online training, online assistance, help and Appshelp. You may choose not to 282use these web content features. 283ii. Use of Information. We may use the computer information, error reports, and 284CEIP information, to improve our software and services. We may also share it 285with others, such as hardware and software vendors. They may use the 286information to improve how their products run with Microsoft software. 287iii. Misuse of Internet-based Services. You may not use these services in any 288way that could harm them or impair anyone else’s use of them. You may not use 289the services to try to gain unauthorized access to any service, data, account 290or network by any means. 291 2923. BACKUP COPY. You may make one backup copy of the software. You may use it 293only to reinstall the software. 294 2954. DOCUMENTATION. Any person that has valid access to your computer or internal 296network may copy and use the documentation for your internal, reference 297purposes. 298 2995. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only 300gives you some rights to use the software. Microsoft reserves all other rights. 301Unless applicable law gives you more rights despite this limitation, you may 302use the software only as expressly permitted in this agreement. In doing so, 303you must comply with any technical limitations in the software that only allow 304you to use it in certain ways. You may not 305Except for the Microsoft .NET Framework, you must obtain Microsoft's prior 306written approval to disclose to a third party the results of any benchmark test 307of the software. 308work around any technical limitations in the software; 309reverse engineer, decompile or disassemble the software, except and only to the 310extent that applicable law expressly permits, despite this limitation; 311make more copies of the software than specified in this agreement or allowed by 312applicable law, despite this limitation; 313publish the software for others to copy; 314rent, lease or lend the software; 315transfer the software or this agreement to any third party; or 316use the software for commercial software hosting services. 317 3186. EXPORT RESTRICTIONS. The software is subject to United States export laws 319and regulations. You must comply with all domestic and international export 320laws and regulations that apply to the software. These laws include 321restrictions on destinations, end users and end use. For additional 322information, see www.microsoft.com/exporting. 323 3247. SUPPORT SERVICES. Because this software is “as is,” we may not provide 325support services for it. 326 3278. ENTIRE AGREEMENT. This agreement, and the terms for supplements, updates, 328Internet-based services and support services that you use, are the entire 329agreement for the software and support services. 330 3319. APPLICABLE LAW. 332a. United States. If you acquired the software in the United States, Washington 333state law governs the interpretation of this agreement and applies to claims 334for breach of it, regardless of conflict of laws principles. The laws of the 335state where you live govern all other claims, including claims under state 336consumer protection laws, unfair competition laws, and in tort. 337b. Outside the United States. If you acquired the software in any other 338country, the laws of that country apply. 339 34010. LEGAL EFFECT. This agreement describes certain legal rights. You may have 341other rights under the laws of your country. You may also have rights with 342respect to the party from whom you acquired the software. This agreement does 343not change your rights under the laws of your country if the laws of your 344country do not permit it to do so. 345 34611. DISCLAIMER OF WARRANTY. The software is licensed “as-is.” You bear the 347risk of using it. Microsoft gives no express warranties, guarantees or 348conditions. You may have additional consumer rights or statutory guarantees 349under your local laws which this agreement cannot change. To the extent 350permitted under your local laws, Microsoft excludes the implied warranties of 351merchantability, fitness for a particular purpose and non-infringement. 352FOR AUSTRALIA – You have statutory guarantees under the Australian Consumer 353Law and nothing in these terms is intended to affect those rights. 354 35512. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. You can recover from 356Microsoft and its suppliers only direct damages up to U.S. $5.00. You cannot 357recover any other damages, including consequential, lost profits, special, 358indirect or incidental damages. 359This limitation applies to 360anything related to the software, services, content (including code) on third 361party Internet sites, or third party programs; and 362claims for breach of contract, breach of warranty, guarantee or condition, 363strict liability, negligence, or other tort to the extent permitted by 364applicable law. 365It also applies even if Microsoft knew or should have known about the 366possibility of the damages.
